% 24.04.2015 Petitioner and respondent no.1 are residents of same locality. They are known to each other.
One procession of 'Nagar Kirtan' was passing through the Gali where house of respondent no.1 was located. Respondent no.1 was standing in his balcony and watching the said procession. Petitioner was part of the said procession. He fired twin shots in the air from his revolver and when respondent no.1 objected to his this act, petitioner fired a shot aiming respondent no.1from his licenced revolver. This incident has led to registration of present FIR No.1247/14 under Sections 307/506/34 IPC coupled with Sections 25/27 of the Arms Act at police station Bindapur on 2nd November, 2014, on the complaint of respondent no.1. During the
investigation itself, petitioner and respondent no.1 have settled their disputes amicably being residents of same locality. It is submitted that petitioner and respondent no. 1 are now maintaining good relations. Petitioner has no past criminal record.
Respondent no.1 did not sustain any injury in the incident. Respondent no.1 is present in Court and states that he has no objection in case FIR is quashed.
Keeping in mind the above facts, in my view, no fruitful purpose would be served in keeping the parties entangled in criminal proceedings more so when they are living in the same locality and have resolved their disputes amicably. Accordingly, FIR 1247/14 under Sections 307/506/34 IPC coupled with Sections 25/27 of the Arms Act registered at police station Bindapur and the consequent proceedings emanating therefrom are quashed, subject to, however, costs of `25,000/- (Rupees Twenty Five Thousand Only) to be deposited with Delhi High Court Mediation & Conciliation Centre within two weeks. Receipt, evidencing deposit of cost, be filed in the Registry and a copy thereof be given to the Investigating Officer. Writ petition is disposed of in the above terms. A.K. PATHAK, J.
