The present petition has been filed under Section 528 of Bhartiya Nyaya Sanhita, 2023 (hereinafter referred to as 'BNS'), inter alia, seeking the following reliefs:
"a) Exercise its inherent powers under Section 528 of the Bharatiya Nyaya Sanhita, 2023, to call for the records of S.C. No. 7337/2016 from the court of the Learned Additional Sessions Judge-02 (South), Saket Courts, New Delhi, and after examining the legality, propriety, and correctness of the impugned order dated 06.06.2026, be pleased to quash and set aside the same; b) Direct the Respondent No. 1 to provide adequate, The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
round-the-clock security, comprising of at least two armed police personnel, to the Petitioner and his family members during the entire period that the Respondent No. 2 remains on interim bail or until the threat perception subsists;
c) Pass any other or further order(s) as this Hon'ble Court may deem fit and proper in the interest of justice." 4.
Learned counsel for the Petitioner submits that the Petitioner is the complainant in a case registered under Section 302 of the Indian Penal Code, 1860 (hereinafter referred to as 'IPC') against Respondent No. 2, who is stated to have committed the murder of the Petitioner's father. He submits that despite moving an application before the learned ASJ seeking security for himself and his family members, the same has been dismissed vide the impugned order dated 06.06.2026.

Learned APP for the State accepts notice. Learned counsel for Respondent No. 2, who appears on advance notice, also accepts notice. 7.
Learned APP submits that a bare perusal of the impugned order would show that nowhere has the application seeking security for the complainant and his family members been rejected by the learned Trial Court and that the learned Trial Court has only directed the DCP, South West District to ensure that the undertakings given in the reply are complied with diligently. 8.
A perusal of the record shows that though the application has not been rejected by the learned Trial Court, the Applicant claims threat to his life. Since Respondent No. 2 is on bail and the Applicant is the complainant in a case under Section 302 IPC, at best, it would be appropriate that the Applicant moves an appropriate application before the learned Principal District & The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
Sessions Judge, South District, Saket Courts. The learned Principal District & Sessions Judge shall place the matter before the Witness Protection Committee of the concerned District for consideration and appropriate orders within a period of 10 days from the date of filing of such application shall be passed.

In the meantime, the DCP, South-West District shall ensure adequate security arrangements for the Petitioner, in addition to providing the contact details of the beat staff, one police official in plain clothes shall also be provided for the security of the Petitioner till the application is considered by the Witness Protection Committee of the concerned District. 10.
This petition is disposed of.
