The petition under Article 226 of the Constitution of India read with Section 482 of the Cr.P.C., Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeks the following prayers: - "(a) Quash the FIR Number: 0046/2024 for offences under section, 419/420/3 79 of Indian Penal Code, 1860, ("IPC") now under section 319(2)/ 318 (4)/ 303(2) of the Bhartiya Nyaya Sanhita 2 0 2 3 registered at: Cyber Police Station, Central, Delhi; and Pass any further order which this Hon'ble Court deem fit in the facts and circumstances of the case and in the interest of justice." 3.
Learned counsel appearing on behalf of the petitioner seeks leave to withdraw the present petition on account of the fact that respondent no. 2/ complainant-Binod Kumar has since passed away.
