In the order dated 08.01.2024, this Court had recorded the submissions of the learned counsel appearing for the Complainant that in a complaint filed under Section 138 read with Section 142 of the Negotiable Instruments Act, 1881, bailable warrants have been issued against the applicant as he was not found at the given address. 2.

Based on the above submission, the applicant was directed to file, on an affidavit, his current address with his mobile number, after supplying a copy thereof to the learned counsel for the Complainant and the Investigating Officer (IO).

The applicant has filed an affidavit stating that he is residing at C-4/360, Ground Floor, Yamuna Vihar, Delhi-110053. 4.

submits that the said address is incorrect and the applicant is, in fact, found residing at C-4/359, Ground Floor, Yamuna Vihar, Delhi110053, and has been residing there since 2018 as a tenant. The Status Report/Verification be taken on record.

It is clear that the applicant has filed a false affidavit before this Court and is intentionally avoiding service in other proceedings. This conduct of the applicant disentitles him to any relief from this Court. 6.

Accordingly, the bail application is dismissed.
