The present application has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the 'BNSS') seeking interim bail for a period of two months on behalf of the Applicant in FIR No. 901/2025, registered at Police Station Wazirabad, Delhi, under Sections 103 and 238 of the Bharatiya Nyaya Sanhita, 2023 (hereinafter referred to as the 'BNS').

Learned counsel for the Applicant submits that the Applicant's daughter is only two months old and is unable to consume formula milk. It is submitted that the child is completely dependent upon the Applicant for breastfeeding and is also suffering from various medical ailments. 4.
The Status Report filed by the State is taken on record. 5.
The documents placed on record have been verified by the Investigating Officer. Though the allegations against the Applicant are serious in nature, considering the medical condition of the Applicant's two month old daughter and the fact that she is wholly dependent upon the Applicant for breastfeeding, the Applicant is granted interim bail for a period of two months from the date of her release, on furnishing a personal bond in the sum of Rs.25,000/- with one surety of the like amount, to the satisfaction of the concerned Jail Superintendent, subject to the following conditions: (i) The applicant shall furnish a personal bond in the sum of Rs. 25,000/- with one surety in the like amount, to the satisfaction of the concerned Jail Superintendent.
(ii) The applicant shall not leave Delhi NCR without prior permission of the learned Trial Court and shall ordinarily reside at the address as per prison records and if she wishes to change her residential address, she shall immediately intimate the same to the concerned IO by way of an affidavit.
(iii) The applicant shall also surrender her Passport, if any, to the concerned Jail Superintendent.
(iv) The applicant shall not contact/ visit/ offer any inducement/ threaten/ promise/ attempt to influence any of the prosecution witnesses or other persons acquainted with the facts of the case. The applicant shall not tamper with evidence nor otherwise indulge in any act or omission that is unlawful or that would prejudice the proceedings in the pending trial.
(v) Since the husband of the applicant is the main prosecution witness, she shall not be allowed to meet her husband. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
(vi) Upon expiry of the period of two months of interim bail from the date of her release, the applicant shall surrender before the concerned Jail Superintendent on or before 04:00 PM on the said date of expiry of the interim bail.
