The instant petition is for the following reliefs:- "I. Issue a Writ of Mandamus or appropriate writ, direction or order thereby:
a. To direct the Respondent to allow the Application dated 25.03.2023 of the Petitioner for the migration of the Channel, „Tune 6 Music‟, satellite from IS-17 to GSAT-30;
II. Pass any other order or orders which may be deemed fit and proper in the facts and circumstances of the case and in the interest of justice." 2.
The facts of the case would indicate that the petitioner was granted permission to Uplink and Downlink a Music channel (Non-News & Current Affairs TV Channel) namely 'Tunes 6 Music' vide letter dated 08.03.2017, which was valid upto 07.03.2027. It is stated that as per Clause 2(h) and (i) of the permission letter dated 08.03.2017, the petitioner was required to pay Annual Permission Fee @ Rs. 5,00,000/- per year for downlinking of channel and @ Rs. 2,00,000/- per year for uplinking of TV Channel, 60 days before such fee becomes due.

The petitioner was not making the payment of Annual Permission Fee, the concerned Ministry took up repeated follow up action. The petitioner then paid a part payment of the aforesaid dues. Since, the full payment was not made, therefore, the Show Cause Notice was issued and the impugned action was taken. In the meantime, the petitioner applied for change of satellite from IS-20 to GSAT-30 on the existing teleport of M/s Planetcast Media Services Limited, which was examined and the petitioner was informed that on account of outstanding dues, the action could not be taken. The petitioner do not dispute the payment of outstanding dues, and however submits that on account of financial crunch, the petitioner be granted liberty to make the payment and instalment and in the meantime, the petitioner's pending application dated 25.03.2023 be allowed permitting migration of the channel "Tunes 6 Music" to GSAT-30 satellite. 4.
The Court in exercise of power under Article 226 of the Constitution of India may not be fully equipped to accept the aforesaid prayer. 5.
If the petitioner has a reasonable cause to put forth, let the same be considered by the appropriate authority i.e. the Ministry of Information and Broadcasting.

In view thereof, the mandamus cannot be issued and instead the petitioner is permitted to file a representation to the concerned Ministry. If the petitioner does so, let the same be considered and appropriate orders be passed in accordance with law.

With the aforesaid observations, the instant petition stands disposed of.
