This is a joint application on behalf of the plaintiff and the defendant/counter claimants under Order XXIII Rule 1 and 3 of the Code of Civil Procedure, 1908 seeking to withdraw the suit as well as the counter claims.

It is stated in the application that the parties have entered into a settlement by way of an agreement dated 18th October, 2024, and in view of the settlement the parties have agreed to withdraw the suit as well as the counter claims.

The application is duly supported by the affidavit of the authorised representative of the plaintiff and the defendants. For the reasons stated, the application is allowed and the plaintiff is permitted to withdraw the suit and the defendant is permitted to withdraw its counter claims.

In view of the order passed above, the captioned suit as well as the two captioned counter claims are dismissed as withdrawn. 6.
