Learned counsel for the petitioner has challenged the impugned order dated 10.06.2026, whereby learned Appellate Tribunal Municipal Corporation Of Delhi (ATMCD) had declined to grant adjournment sought by the petitioner herein on the ground that the petitioner (appellant before ATMCD) is seeking adjournment on one or another ground and is misusing the benefit of interim protection.

counsel was hospitalized and that is the reason that the adjournment was being sought. However, learned counsel for petitioner submits that he has recently been engaged by the petitioner and now he undertakes to appear and participate in proceedings before ATMCD on each and every date. 5.

I have considered the submissions. Though, I am not satisfied with the submissions of learned counsel for the petitioner but still in the interest of justice, I grant one more opportunity to the petitioner to appear and participate in the proceedings before ATMCD. It is undertaken by learned counsel for petitioner that he will not seek any adjournment henceforth. 6.

Consequently in view of this undertaking the impugned order vide which interim protection was vacated and MCD was directed to take action as per law is hereby set aside and the interim protection is continued till next date of hearing before ATMCD.

It is made clear that if petitioner-appellant before the ATMCD indulges in any further dilatory tactics, the ATMCD would be fully within its rights to vacate the interim protection.
