The present petition has been filed in the nature of Habeas Corpus directing the respondents, particularly, the respondent no. 2, to produce the minor child of the petitioner aged about 4 years 9 months, before this Court. This Court notes that in the petition itself, it has been mentioned that the minor child has been taken by respondent no. 2, i.e., the father, and the minor child is staying with his father in his native village. 5.

This Court is further informed by learned counsel appearing for the GNCTD that the minor child was taken on 08th May, 2026. 6.

The respondent no.1, i.e., the State (Government of NCT of Delhi) ("GNCTD") has handed over to this Court a Status Report, which is taken on record.

As per the status report also, as submitted by the SHO, Police Station Dayalpur, the minor child is staying at the native village of respondent no.2, i.e., Village Chuhanala, District Pithoragarh, Uttarakhand, along with the respondent no. 2, his father.

Accordingly, considering the Status Report, as filed on behalf of the police, it is apparent that the minor child is staying with his father in the native village of his father.

At this stage, learned counsel appearing for the petitioner submits that they are not able to contact the respondent no. 2, since he has switched off his mobile phone.

Per contra, learned counsel appearing for GNCTD submits that the respondent no. 2 is available on his mobile number. 11.

At this stage, respondent no. 2, i.e., Mr. Vivek Singh, has joined the Court proceedings through Video Conferencing ('VC'), along with the minor child, from his native village.

Respondent no. 2 submits that the minor child has been admitted to a school and is duly attending the school.

Accordingly, in view of the submissions made before this Court, liberty is granted to the petitioner to avail her remedies in accordance with law and to seek custody of the minor child.
