The present writ petition has been filed by the petitioner through his father Mr. Surender Kumar who had applied for admission in the 6th standard to Sainik School for the academic year 2026-27 under the OBC category.

Mr. Prasanna S., learned counsel for the petitioner submitted that the petitioner has scored 266 marks out of 300, putting him in a highly meritorious position. window offered, he lost the opportunity to be admitted to any Sainik School across India.

Accordingly, the petitioner prays that the admission of the petitioner may be done anywhere across India in his preferred eight schools, the list of which has been mentioned at page 13 of the paper book of the petition. 5.

It is further submitted that presently the petitioner has been put under the spot counselling category allotted in Sainik School in Mizoram. 6.

It is prayed that directions be issued that the petitioner be admitted to any of the preferred schools.

Learned counsel for the respondent, however, submits that interference in the allotment of schools would open a Pandora's Box and it is not feasible for the respondent to grant admission to the petitioner to any of the preferred schools at this stage. However, he submits that if any vacancy arises in any of these schools in ordinary course and as per the Standard Operating Procedure (SoP), the respondent will consider the case of the petitioner in accordance with the rules. 8.

In view of the above, this Court is of the opinion that this offer and statement by learned counsel for the respondent is fair and therefore, it is directed that the respondent shall consider the case of the petitioner sympathetically in accordance with the SoP and as per law and considering all factual circumstances, if feasible, grant the petitioner admission in the eight preferred schools mentioned in the petition. 9.

The petition is disposed of accordingly.
