% 04.10.2024 I.A. 41308/2024 in CS(OS) 417/2023(on behalf of the plaintiff under Section 151 of CPC seeking permission to withdraw the present suit) 1.

This is an application filed by the plaintiff seeking leave to withdraw the present suit in terms of the settlement agreement dated 30.09.2024 executed between the plaintiff and defendant no. 13. The settlement agreement dated 30.09.2024 is annexed with the application. 2.

It is stated in the application that with the execution of the settlement agreement dated 30.09.2024, the claims of the plaintiff do not survive and stand settled. It is stated that in view of the said settlement agreement, the present suit become infructuous.

does not wish to pursue the present suit against defendant nos. 1 to 12 in view of their statement recorded in the order dated 14.07.2023 and the subsequent compliance of the said statement by defendant nos. 1 to 12. 4.

The statement of the plaintiff is taken on record and the present suit CS(OS) 417/2023 is accordingly dismissed as withdrawn. 5.

Pending applications stands disposed of.

All future dates stand cancelled.
