This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers:- "A. issue a writ of certiorari or any other suitable writ or order quashing & setting aside impugned refusal order dated 15.05.2026 of Western Regional Committee; and/or B. issue a writ of mandamus or any other suitable writ or order or direction to respondents to decide petitioner's application for recognition of conversion/transition of existing 4 year integrated B.A.B.Ed/B.Sc.B.Ed course to ITEP course from present academic session 2026-27 expeditiously and in time bound manner;

The case of petitioner is that it is an old institution which was granted recognition for 4 year integrated B.A.B.Ed./B.Sc.B.Ed course by Northern Regional Committee (NRC) on 03.03.2016 for academic session 2016-17 with intake of 50 seats (one basic unit). 25.08.2025 & 12.09.2025, it submitted application dated 03.10.2025 seeking transition of existing B.A.B.Ed/B.Sc.B.Ed course to ITEP course. The inspection of petitioner institute was carried out on 02.01.2026 and finding institute compliant with norms & standards of NCTE, NRC issued Letter of Intent (Lol) dated 26.02.2026 under Regulations 7 (13) Regulations 2014 requiring petitioner to submit compliance thereof. 3.

The grievance of petitioner is that although it submitted compliance of LoI through portal still a show cause notice dated 21.04.2026 was issued by NRC. The petitioner submitted reply to said show cause notice on portal along with requisite documents and approved faculty list, however, without considering said reply to show cause notice, respondent NRC has passed impugned order dated 15.05.2026 rejecting petitioner's application for transition on the ground that institution has not uploaded supporting documents with reply.

Learned counsel for petitioner has pointed out that within the period stipulated by the respondents in show cause notice dated 21.04.2026, reply was submitted by petitioner through portal. He has drawn my attention to the reply attached as Annexure P-23 at Page 189 of the petition. 5.

Ld. Counsel appearing for respondents has opposed the matter and submitted that impugned order does not require any interference by this Hon'ble Court.

Facts are evident from the documents on record. In view of the above, in my opinion, impugned refusal order dated 15.05.2026 issued by NRC has been passed inasmuch as respondent did not take into account and consider reply to the show cause notice submitted by the Petitioners which was duly received by NRC. Thus, impugned order was passed in haste. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

The said order dated 15.05.2026 passed by NRC is hereby quashed. The matter is remanded back to NRC to reconsider reply to show cause notice dated 21.04.2026 and compliance of Lol submitted by petitioner as per law within a period of two weeks from today. 8.

If, any further information & clarification required, NRC will inform accordingly and petitioner will submit reply within a period of one week. The NRC shall take final decision and pass reasoned and speaking order within a period of 7 days thereafter.

The petition is accordingly disposed of. All pending applications, if any, are also disposed of.
