CORAM:

HON'BLE MR. JUSTICE SURESH KUMAR KAIT

O R D E R

% 08.07.2019 Vide the present petition, the petitioner seeks direction thereby directing respondent no.1 to decide the subject memorandum of charge dated 06.09.2017 issued to the petitioner in an expeditious and time bound manner.

Counsel for the petitioner submits that reply to the memorandum of charge dated 06.09.2017 was filed in the month of September, 2018. However, till date, there is no departmental proceedings. Learned counsel for the respondents appears on advance notice and submits that the petitioner filed reply to the memorandum of charge after an

year and thereafter remained absent in the departmental proceedings, therefore, respondent no.1 could not proceed in the matter. Since departmental proceedings are going on and the petitioner is unauthorisedly absent from the departmental proceedings, I find no merit in the present petition and the same is, accordingly, dismissed with no order as to costs.

Pending application also stands disposed of.
