This application has been preferred on behalf of the Petitioner for revival of the writ petition on the ground that despite a statement given before this Court on 10.07.2024, received on instructions, by email which is also referred to, in paragraph 6 of the order, that the enquiry report is under process and will be submitted before 20.07.2024, the disciplinary proceedings have not been completed till date and the matter is pending with the Disciplinary Authority to take a decision, after the Petitioner has furnished his representation against the disagreement note, rendered by the Disciplinary Authority.

Mr. Manoj, learned counsel, on the other hand submits that the assurance was only to the extent that the enquiry report will be submitted before 20.07.2024 and there was no assurance that the Disciplinary Authority will render its decision. He, however, assures on instructions, from the GM (Vigilance) that disciplinary authority will take a decision on or before the expiry of 06 weeks from today.

The assurance is taken on record. Needless to state that if the undertaking is not adhered to, Petitioner will be at liberty to revive the petition, subject to the objection on its maintainability raised by Mr. Manoj. 4.

Application stands disposed of.
