CM APPL.71592/2025 (filed on behalf of petitioner for directions) 1.

The present petition was filed by the petitioner seeking registration as a Category I Haj Group Operator (HGO) for Haj 2024. Since the Haj 2024 stands concluded, the prayers in the present petition have become infructuous.

Learned counsel for the petitioner confines itself to seeking return/ refund of security deposit of Rs. 30,00,000/- to the petitioner. True copy of the Fixed Deposit dated 27.03.2023 in A/c No. 790056110000295 with Bank of India Srinagar Branch has been appended along with the application as Annexure A/3. The said Fixed Deposit was submitted towards the security deposit. It is further submitted that the aforesaid Fixed Deposit was rolled over; the amount continues to remain with the concerned bank, with the lien marked in favour of the Haj Committee. 3.

said security deposit is required to be released to the petitioner. It is further submitted that although the petitioner was earlier under the investigation by the Directorate of Enforcement, vide letter dated 07.04.2025 the Directorate of Enforcement has informed the respondent that the said investigation has been closed and no contravention has been found. 4.

It is further pointed out that although there is a pending investigation before NIA, no communication has been addressed by the NIA objecting to the release of security deposit to the petitioner. Accordingly, the said investigation does not operate as an impediment to the release of security deposit to the petitioner.

In the circumstances, the present application is allowed; the security deposit of Rs. 30,00,000/- along with the accrued interest lying with Bank of India in fixed deposit in A/c No. 790056110000295, be released to the petitioner forthwith.

The present application along with the main writ petition stands disposed of.
