The present appeal has been filed challenging the order dated 24th June, 2026 passed by the learned Single Vacation Judge in W.P.(C) 7944/2026, titled as Devisree Srinivasan Versus National Testing Agency. 2.

The impugned order dated 24th June, 2026, passed by the learned Single Vacation Judge, reads as under:

"CM APPL. 39177/2026 (Early Hearing) 1.

I am not inclined to prepone the present matter. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Accordingly, the application stands dismissed. W.P.(C) 7944/2026 CM APPL. 39178/2026 3.

List this matter before the Roster Bench on 24.07.2026, i.e. the date already fixed."

Perusal of the aforesaid order shows that learned Single Vacation Judge has simply stated that he was not inclined to advance the hearing of the matter and has listed the matter before the Roster Bench on the date already fixed, i.e., 24th July, 2026.

This Court has also perused the CM APPL. 39177/2026, application for early hearing which was listed before the learned Single Vacation Judge, in which the impugned order dated 24th June, 2026, has been passed. 5.

This Court notes that in the said application, the only prayer made by the appellant herein was with regard to advancing the date of hearing and for taking up the matter for hearing.

On the contrary, before this Court in the present appeal, the appellant is praying for a completely different relief, namely, for taking up the examination, i.e., Foreign Medical Graduate Examination ("FMGE") June 2026 Session, as an interim relief, which was not even the prayer in the application for early hearing before the learned Single Vacation Judge or as an interim relief before the Roster Bench.

Thus, a completely new plea has been raised before this Court for the first time, which was never raised before the learned Single Vacation Judge, which cannot be allowed.

Accordingly, no merit is found in the present appeal. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

The present appeal, along with pending applications, is accordingly dismissed.
