There is no appearance on behalf of Petitioner. The Petitioner's grievance relating to non-compliance of the Manual for Procurement, 2022 and General Finance Rules, 2017 by the Respondents in relation to Bid No. GeM/2022/B/2541246 dated 07th October, and No.

GeM/2023/B/3270818 dated 16th March, 2023. The Petitioner alleges that the Respondents have been asking the bidders for submission of additional documents, which are not in the nature of historical documents, during evaluation of bids. In such circumstances, the Petitioner seeks the following prayers:

"(a) Issue of writ of mandamus or any other appropriate writ or directions to the Respondents for strict compliance of Manual for Procurement of Goods 2022 while evaluation of Bids and awarding Contract. (b) Issue writ of mandamus or any other appropriate writ or directions to the Respondents thereby directing them to declare all the Bidders as The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. unresponsive who had not met the basic requirements specified in the bid and failed to submit all the requisite documents as per tendered enquiry. (c) Pass such other and further order as this Hon'ble Court deems fit and proper in the interest of justice."

Counsel for Respondents states that they always follow the Manual for Procurement, 2022 while evaluation of bids and awarding contracts. Nonetheless, the grievance of the Petitioner which prompted them to file the present petition, no longer survives as the competent authorities have issued communications for scrapping of the above-noted tenders. A copy of the same is handed over across the Board and is taken on record. 3.

In light of the above and the fact that there has been no appearance on behalf of the Petitioner since past several dates commencing from 14th September, 2023, 27th February, 2024, 18th July, 2024 to today, it is evident that the Petitioner is no longer interested to pursue with the present petition for the reasons noted above.
