% 09.05.2024 Learned counsel appearing on behalf of petitioner seeks leave to withdraw the instant petition with liberty to take appellate remedy under the statutory provisions.

Per contra, learned counsel appearing on behalf of respondent submitted that liberty may not be granted to the petitioner as the liberty may constitute that the delay in filing the appeal before the Appellate Authority shall be treated as condoned and the same may be adjudicated by the Appellate Authority in accordance with law.

In view of the above, leave granted.
