% 31.05.2019 CM APPLN. No.27614/2019 1.

Allowed, subject to all just exceptions.

The application is disposed of.

WP(C) No.6532/2019 & CM APPLN. NO.27613/2019 3.

Issue notice. The learned counsel appearing for the respondents accepts notice.

4.

The petitioner has filed the present petition, inter alia, impugning an order dated 17.05.2019, whereby the flat allotted to the petitioner (Flat bearing No.G, Block-A2, First Floor, 16-B, Dwarka, New Delhi) was cancelled. The said flat was allotted to the petitioner as part of the Scheme to rehabilitate jhuggi dwellers residing in Nehru Camp, Patparganj, Delhi. 5.

The said allotment has been cancelled as it was found that the

petitioner's parents had also availed of benefits of the said Policy and the petitioner was shown as part of their family. 6.

The learned counsel appearing for the petitioner fairly states that the cancellation order is not erroneous on merits. He, however, requests that some time be given to the petitioner to make alternate arrangements. 7.

In view of the above, the present petition is disposed of by directing that if the petitioner submits an undertaking by way of an affidavit to vacate the said premises within a period of three months from today, DUSIB shall restrain itself from taking any coercive steps during the said period of three months.

8.

The petition and the pending application are disposed of in the aforesaid terms.
