By way of present petition under Article 226 of the Constitution of India, the petitioners seek expeditious trial in case FIR No.130/2012 under Sections 498A/406/506/34 IPC registered at PS Mianwali Nagar pending before learned MM.

Learned counsel for the petitioners states that even earlier, the petitioners had approached this Court by way of a petition being W.P. (Crl.) No.725/2022 when the Coordinate Bench observing that since the matter is pending trial since 2016, directed the Trial Court to expeditiously decide the same preferably within one year.

Learned ASC (Crl) for the State submits that thereafter by another direction given vide order dated 10.04.2023 passed in Crl. M.C.2358/2023, the time to conclude the Trial was extended by another six months. submits that thereafter directions were sought to re-examine three of the prosecution witnesses out of which one has already been re-examined and two remains. He submits that in view of the aforesaid, the trial is pending. 4.

Learned counsel for the parties inform that the next date before the Trial Court is 10.07.2024.

In view of the above, the Trial Court shall make an endeavour to conclude the trial preferably within a period six months from the next date fixed before it.

The petition is disposed of in above terms along with pending application.
