The present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023 (hereinafter "BNSS") [earlier Section 482 of the Code of Criminal Procedure, 1973] has been filed by the petitioner seeking quashing of the entire complaint case being Complaint Case No.04/2023 pending before the learned Metropolitan Magistrate (Central), Tis Hazari Court, Delhi.

Respondent appears in person through video conferencing and submits that she would like to withdraw the aforesaid complaint case pending before the Court of learned Metropolitan Magistrate by moving appropriate application before the appropriate forum. 3.

Learned counsel for the petitioner submits that in view of aforesaid submission of the respondent, the present petition has become infructuous and may be disposed of on the said ground.
