% 27.09.2016 C.M.No. 35888/2016 By this application, recalling of order of 9th July, 2014 is sought. Vide aforesaid order, the appeal has been disposed of by consent. Learned counsel for applicant-respondent submits that appellant is prolonging the proceedings before the trial court and cost was tendered on the last date of hearing, which was accepted by respondent on the asking of the trial court but the cheque has not been encashed. Be that as it may. No case for recalling of order of 9th July, 2014 is made out.
It is expected that the trial court shall proceed to hear the parties and shall make all the endavours to decide the pending matter within a period of six months from the date fixed, as it is stated that the matter is relating to the year 1988 and is pending before the trial court at the stage of final arguments.
