CRL.M.A. 23049/2024 (under Section 482 Cr.P.C on behalf of the petitioner for Restoration of Writ Petition) 3.

An application has been filed for restoration of the present Petition which got dismissed in default vide Order dated 11.07.2024. 4.

It is submitted that the learned counsel for the petitioner had joined through Video Conferencing, but because of the disturbance, his attendance could not be marked. It is submitted that in the circumstances, the Petition be restored.

Learned Prosecutor has no objection to the restoration of the Petition. 6.

It is submitted on behalf of the learned counsel for the petitioner that since the charges have already been framed in this case, he may be permitted to withdraw the present petition with liberty to challenge the Order on Charge in accordance with law.

In view of the submissions made, the petition is permitted to be withdrawn.

In so far as the delay is concerned, learned counsel for the petitioner is at liberty to move appropriate application, which be considered in accordance with law.

It is hereby clarified that there are no expression on merits by this Court.
