By way of the present petition under Sections 438 and 442 of the BharatiyaNagarik Suraksha Sanhita, 2023, the petitioner assails a judgement dated 10.02.2026, passed by the Principal Judge, Family Courts, South District, Saket Courts, New Delhi. By the said judgment, the Family Court disposed of the interim maintenance application filed by the respondent and directed the petitioner to pay Rs. 10,000/- per month till final disposal of the proceedings.

After some arguments, Mr. Sunil Prakash Sharma, learned counsel for the petitioner, seeks permission to withdraw this petition, without prejudice to the petitioner's rights and contentions before the Family Court in the pending proceedings instituted by the respondent. 3.

Mr. Sharma also submits that the petitioner would like to make an effort to settle the disputes comprehensively with the respondent. further submits that he will request the Family Court to make a reference to mediation before the Delhi High Court Mediation and Conciliation Centre, Shershah Road, New Delhi-110503.

The petitioner may make this request to the Family Court and, subject to the submissions of the respondent, the Family Court is requested to consider the requests of the petitioner in accordance with law, and make a reference to mediation, if appropriate. 5.

The petition, alongwith pending applications, is dismissed as withdrawn with the aforesaid observations.
