% 19.02.2018 The petitioner is seeking quashing of the present FIR. The FIR has initially been registered under Section 354(A) of the IPC. It was only on a subsequent statement made by the complainant, which as per the petitioner was recorded after a gap of more than one year and nine months that Section 376 of the IPC was added to the present FIR. It is on this premise largely that the petitioner seeks quashing of the FIR besides the other grounds.

Learned counsel for the state points out that the investigation in this FIR is complete and the charge sheet is ready; which shall be filed in the competent court within an outer limit of two weeks. This statement of the learned counsel for the respondent is taken on record. Learned counsel for the petitioner, at this stage, seeks permission of this court to withdraw the present petition. Permission

granted.

Petition dismissed with liberty granted to the petitioner to argue all the aforenoted facts as narrated supra as also the contents and the averments made in the petition before the appropriate court at appropriate stage.
