By virtue of the present petition under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), the petitioner seeks the following reliefs: "A. Issue an appropriate writ, order or direction directing the Court of Ld. Chief Judicial Magistrate, South District, Saket Courts, New Delhi, to take up and dispose of CT Cases No. 464770/2016 titled Kamlesh & Ors. vs. Bhagwan Dass & Ors. in a time-bound manner, preferably within an outer period of three to six months, or within such period as this Hon'ble Court may deem fit and proper;

B.

charge/clarifications in CT Cases No.464770/2016 be concluded on short dates and an order thereon be passed expeditiously, uninfluenced by the pendency of any crosscomplaint except to the extent strictly required by law; C.

Direct the parties to cooperate in early disposal and restrain avoidable adjournments except for compelling reasons;

D.

Pass such other or further order(s) as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case."

Learned APP for the State accepts notice and submits that he has no objection if the present petition is allowed. 6.

Considering that the CT Cases No. 464770/2016 was filed way back in the year 2016 and the pre-summoning evidence was closed on 25.11.2022, without adverting to the other issues/ merits involved, this Court deems it appropriate to request the learned Chief Judicial Magistrate, South District, Saket Courts to dispose of the aforesaid complaint as expeditiously as possible, preferably on or before 31.03.2027. Needless to say, none of the parties shall be allowed to take any unnecessary adjournment(s) till such time. 7.

In view thereof, notice to respondent no.2 is dispensed with. 8.

As such, the present petition is disposed of. 9.
