By way of the present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioner seeks quashing of the complaint as well as all proceedings arising out of CC NI Act No. 35617/2024, and seeks setting aside of the summoning order dated 16.01.2025 passed by the learned Municipal Magistrate (JMFC), Dwarka Courts, Delhi.

After some arguments, Mr. Imon Bhattacharya, learned counsel for the petitioner, on instructions, seeks permission to withdraw the present petition, without prejudice to the rights and contentions available to the petitioner in the proceedings under Section 138 of the Negotiable Instruments Act, 1881.
