The present writ petition has been filed seeking appropriate action in respect of the unauthorized construction carried out by respondent no.4 at property bearing No. New MS-28, Mohan Garden, Uttam Nagar, New Delhi - 110059 ('subject property'). It is stated that the petitioner is an immediate neighbour residing at MS-37, Mohan Garden, Uttam Nagar, New Delhi - W.P.(C) 8406/2026 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. 110059. A copy of the site plan is filed along with the present writ petition. 3.

It is further stated that a complaint has been made with the respondent-MCD by the petitioner. However, no action has been taken. 4.

Mr. Sunil Goel, counsel appearing on advance notice on behalf of respondent-MCD, submits that a show cause notice was issued in respect of the unauthorized construction on 27th May, 2026. However, no reply thereto was received. Accordingly, a demolition notice has been issued on 29th June, 2026.

The show cause notice and the demolition notice have been handed over in Court and the same are taken on record. 6.

Taking the aforesaid submission on record, the present writ petition is disposed of while directing respondent-MCD to take appropriate action in accordance with law.

In the event the petitioner has any further grievance with regard to unauthorised construction, he is at liberty to take appropriate remedies in accordance with law.

All rights, contentions and legal remedies of the private respondents no.3 and 4 shall remain protected.
