O R D E R

% 16.11.2017 RFA No.235/2017 & CM No.41542/2017 (Order XXIII CPC for settlement) 1.

Both the parties have settled their disputes amicably. As per the settlement, the appellant/defendant shall pay the amount of Rs.1,58,132/- with interest @12% per annum from the date of filing of the suit till the date of the judgment & decree of the Trial Court i.e. up to 27.09.2016 and future interest @ 6% per annum from the date of the decree till the realization of the decretal amount.

Mr.Shyam Sundar Bhagat, Director of the appellant company, submits that as per the settlement arrived at, he has deposited Rs.2,15,060/- with the Registry of this Court. He further submits that he has no objection if the said amount of Rs.2,15,060/- deposited in view of the settlement is released to the decree-holder/respondent.

Settlement is taken on record. Appeal is disposed of accordingly. The parties shall remain bound by the terms of the settlement. 4.

The Registrar General is directed to release the said amount to the decree-holder/respondent.
