Learned counsel for the parties submits that matter has been settled before the learned Mediator.

Settlement Agreement dated 06.03.2017 arrived at between the parties before Delhi High Court Mediation and Conciliation Centre has also been received.

Learned counsel for the parties submit that the appeal may be disposed of in terms of the settlement dated 06.03.2017 arrived at between the parties before the learned Mediator.

Learned counsel for the appellant submits that since the settlement in this case has taken place before commencement of hearing, the Court fee may be ordered to be refunded as per rules.

In view of the submissions made by learned counsel for the parties, RFA 87/2016

the appeal is disposed of in terms of the settlement dated 06.03.2017 arrived at between the parties before Delhi High Court Mediation and Conciliation Centre. The Court fee be refunded as per Section 16A(iii) of Court Fees Act, 1870.
