Applicant seeks regular bail in a case arising out of FIR No.0110/2024 dated 05.07.2024, for commission of offences under Sections 140(1)/103(1)/3(5) of Bharatiya Nyaya Sanhita (BNS), 2023 (corresponding Sections 364/302/34 IPC), registered at P.S. Vasant Vihar. 2.
Learned counsel for applicant submits that even earlier, the applicant had moved similar kind of application (Bail Application No. 1098/2026) but he did not press the same as it was assured by the respondent-State that concerned complainant would appear before the learned Trial Court. result has been placed and, therefore, the trial is, virtually, at a standstill. 3.
Learned Addl. P.P. for State, on instructions from investigating officer, who is present in the Court, submits that material witnesses i.e. Mr. Amit and Ms. Deepa Haldar shall appear before the learned Trial Court on the next date which is 17.07.2026 and it will be ensured that there is no further delay in the matter.

The Director, FSL is hereby directed to ensure that there is no further delay in preparing the FSL result and same be also duly forwarded to the learned Trial Court before the aforesaid date fixed i.e. 17.07.2026. 5.
A copy of this order be given dasti to investigating officer so that he can pursue the matter in this regard with the concerned FSL Authority. 6.
In view of the above, learned counsel for applicant, at this juncture, does not press the present application. He, however, states that if there is no progress in the matter and if on the next date, the witnesses fail to appear before the learned Trial Court and FSL result is also not placed, he may be granted liberty to revive the present application. 7.
Application is accordingly disposed of as withdrawn in the aforesaid terms.

Liberty, as prayed for, is granted.
