By virtue of the present petition under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), petitioner seeks direction to the Competent Authority to ensure proper medical treatment of the petitioner by specialists from All India Institute of Medical Sciences (AIIMS) within the jail premises.

Learned ASC for the State, without adverting to the merits submits that even though the petitioner is in Judicial Custody, and he has not made any representation to the Jail Superintendent, the present petition can be treated as a representation to the Jail Superintendent, who shall endeavour to decide the same as earliest as possible, preferably on or before a period The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
