None appeared for the petitioner on 7th July, 2015, 30th July, 2015, 6th August, 2015, 31st August, 2015, 3rd September, 2015, 16th September, 2015, 24th September, 2015, 28th September, 2015, 7th October, 2015, 30th November, 2015, 8th December, 2015, 9th December, 2015, 11th December, 2015, 15th December, 2015 and 14th January, 2016. On 28th September, 2015 since none was appearing on behalf of the petitioner despite repeated calls the Court issued notice to the parties and their counsel returnable for 30th September, 2015.

On 30th September, 2015 learned counsel for Respondent No.5 informed that the Petitioner had died about three years ago. Thus the matter was directed to be retained in its position in the 'Regular Matters' when later on one Mr.Vatsal Kumar, Advocate appeared for the Petitioner and regretted W.P.(C) 2383/2004

for the non-appearance in the pre-lunch session. He was informed of the order recorded earlier.

Till date no vakalatnama on behalf of Mr.Vatsal Kumar, Advocate has been filed and none has been appearing on behalf of the Petitioner even thereafter as noted above.

Today also none appears on behalf of the Petitioner despite repeated calls.

Petition and the applications are dismissed for non-prosecution. MUKTA GUPTA, J.
