% 23.11.2016 It is represented by the learned counsel for the appellant that in terms of the directions in the order under appeal dated 22.12.2015 in W.P.(C) No.709/2012 and W.P.(C) No.5780/2015, the Lieutenant Governor passed an order on 29.09.2016 directing the change of the land use of the land bearing Khasara No.166 (5-1) as Muslim Kabristan even though the ownership of the land shall continue with Gram Sabha. In view of the said order, the learned counsel for the appellant states that no adjudication is needed on merits of the case and that the appellant may be permitted to withdraw the appeal.
