IN THE HIGH COURT OF DELHI AT NEW DELHI

+ W.P.(CRL) 1714/2019 NARESH KUMAR ..... Petitioner Through:

Mr Sharad Malhotra, Advocate (DHCLSC).

versus STATE ..... Respondent Through:

Mr Tanuj Bhadana, ASC for State.

ASI Mahender, PS Nand Nagri.

CORAM:

HON'BLE MR. JUSTICE VIBHU BAKHRU

O R D E R

% 16.09.2019 1.

The petitioner has filed the present petition, inter alia, impugning an order dated 02.04.2019 passed by the competent authority, thereby rejecting the petitioner's request for parole.

2.

A plain reading of the impugned order dated 02.04.2019 indicates that the petitioner's request for parole was rejected, as his conduct was found to be unsatisfactory.

3.

The petitioner was imposed a punishment on 10.07.2018 and it is submitted on behalf of the respondent that parole cannot be granted if the conduct of the convict is found to be unsatisfactory, during the last one year. 4.

It is seen that one year has passed after the punishment was imposed on the petitioner on 10.07.2018. Thus, the ground on which the petitioner's parole was rejected, does not survive.

5.

In view of the above, the present petition is disposed of directing the

competent authority to consider the petitioner's request for parole afresh in accordance with its rules.
