This is an Application seeking to place on record the statement made on oath by the Appellant before a coordinate bench of this Court with respect to the subject property bearing No. D-604, True Friends Cooperative Group Housing Society Ltd., Plot No. 29, Sector-6, Dwarka, New Delhi [hereinafter referred to as "subject property"]. 1.1 Learned Counsel for the Respondent seeks to rely on the order dated 21.05.2024 passed by a coordinate bench of this Court in a suit for recovery of possession, and mesne profits, CS(OS) No. 834/2022 [hereinafter referred to as "Civil Suit"] filed by the Plaintiff, who is Respondent in the present Appeal, with respect to the subject property. 2.

the subject matter of dispute in the present Appeal, the Application is allowed.

Learned Counsel for the parties draw the attention of the Court to the statement of both the Appellant as well as the Respondent, which have been recorded in the proceedings in Civil Suit.

Learned Counsel for the Appellant submits that by an order dated 03.04.2024 in Civil Suit, a decree for possession was granted in favour of the Respondent (Plaintiff in the Civil Suit) whereby the possession of the subject premises was directed to be handed over within a period of 6 months.

Learned Counsel for the Respondent confirms that the possession of the subject property has already been handed over. He further seeks to rely on the certified copy of the order dated 21.05.2024 passed by a coordinate bench of this Court, which records the same.

Learned Counsel for the parties submit that in view of the aforegoing statements made by the parties in the matter listed before the coordinate bench of this Court, nothing further survives in the present Appeal. 8.

Accordingly, the present Appeal is disposed of. All pending Applications stand closed.
