By way of the present petition filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioners seek quashing of FIR No. 157/2022 dated 14.02.2022, registered at Police Station South Rohini, Delhi, for offences punishable under Sections 323/341/34 of the Indian Penal Code, 1860, alongwith all consequential proceedings arising therefrom, insofar as they relate to the present petitioners. 2.
After some hearing, Mr. Jitendra Kumar Singh, learned counsel for the petitioners, seeks permission to withdraw the present petition, without prejudice to the rights and contentions available to the petitioners before the learned Trial Court, including at the stage of consideration on charge and/or while seeking discharge, in accordance with law. 3.
Mr. Singh further submits that the proceedings pending before the learned Trial Court may be expedited. learned Additional Public Prosecutor, submits that the matter is presently listed for consideration on charge on 23.07.2026. 4.
In the event the learned Trial Court is unable to take up the matter on the said date, it shall be open to the petitioners to move an appropriate application seeking expeditious proceedings. If such an application is made, the learned Trial Court may consider the same in accordance with its own Board and the age of the matters pending before it. Ms. Arya further submits that the prosecution shall extend its cooperation in accordance with the directions of the Trial Court. 5.
The petition, alongwith pending applications, is dismissed as withdrawn, in terms of the above submissions.
