Learned counsel for the respondents submitted that he has received telephonic instructions only today that the Appellate Tribunal, Municipal Corporation Delhi has been conferred with the powers to consider the application of the petitioner. 2.

Learned counsel for the petitioner submitted that the appeal is pending before the Appellate Tribunal, Municipal Corporation Delhi and the application for the interim relief is also pending. 3.

Learned counsel for the petitioner further submitted that in view of the aforesaid submissions, the Appellate Tribunal, Municipal Corporation Delhi may be directed to consider the application of the petitioner immediately preferably by tomorrow itself, i.e. on 4.6.2019, when the appeal is coming up for hearing before the Appellate

Tribunal, Municipal Corporation Delhi. Accordingly, the Appellate Tribunal, Municipal Corporation Delhi is directed to consider the application of the petitioner tomorrow itself and pass appropriate orders.

Meanwhile, no coercive action shall be taken against the petitioner till 4.6.2019 and the Appellate Tribunal, Municipal Corporation Delhi shall pass appropriate orders on the application of the petitioner tomorrow itself, i.e. 4.6.2019. 5.

In view of the aforesaid directions, the learned counsel for the petitioner submitted that he may be allowed to withdraw the petition. Accordingly, the petition is dismissed as withdrawn. Pending application is also dismissed as withdrawn.
