The present application has been filed on behalf of the plaintiff under Order XXIII Rule 1 CPC.

It is submitted that there was an SLP pending in this matter and even the summons were not issued in the present case. Now, the Defendant has gone into insolvency and the remedy of the plaintiff lies before the NCLT. 3.

Therefore, permission is sought to withdraw the present Suit. 4.

In view of the submissions made, the Suit is permitted to be withdrawn.

The application is accordingly disposed of.
