The present petition under Sections 11 and 12 of the Contempt of Courts Act, 1971 seeks the following prayers: "It is, therefore, most respectfully and humbly prayed that this Hon'ble Court may kindly be pleased to exercise power conferred U/S 11 of The Contempt of Court Act against the respondent and accordingly punish the respondent for civil contempt U/S 12 of The contempt of Court Act for his contumacious conduct and wilful disobedience of the order dt.10.12.2024 in C.R.P No. 300/2024, in the interest of justice and equity. It is prayed accordingly." 3.
Vide order dated 26.11.2025, this Court found the respondent/ contemnor guilty of contempt within the meaning of Section 12 of the Contempt of Courts Act, 1971 and further listed the present petition for consideration on quantum of sentence on 17.12.2025. Subsequently, the contemnor preferred an application, CM APPL. 79643/2025, wherein the following prayers were sought: "a. Accept the unconditional apology tendered by the Applicant/Respondent in the accompanying affidavit; b. Exercise the power under Section 12 of the Contempt of Courts Act, 1971, to discharge the Applicant or remit the punishment, in the interest of justice;
c. Pass any other or further orders as this Hon 'ble Court may deem fit and proper in the facts and circumstances of the case." 5.
On 17.12.2025, learned counsel for the petitioners pointed out that apart from the fact that contemnor has not paid the use and occupation charges with respect to property bearing No. H.No.1/11575, Street No. 2, Subhash Park Extension, Naveen Shahdara, Delhi, he is also not vacating the said property. Accordingly, on the said date, contemnor undertook to vacate the said property within two weeks.

On 28.01.2026, it was informed that contemnor has vacated the subject premises. However, the keys have not been handed over to the petitioner. 7.
On 04.02.2026, it was pointed out that the possession of the subject property has been taken over, however, the execution proceedings filed for arrears of use and occupation charges could not proceed on account of nonsupply of present address. Accordingly, this Court directed contemnor to place an affidavit bringing on record his present address. In pursuance thereto, it is pointed out that the contemnor had appeared before the learned Execution Court and original affidavit dated 16.03.2026 have been handed up in Court today and it is taken on record, wherein in para-4, he has given his address as under:
"Present Address: H.No. 1, Gali No. 1, East Vinod Nagar, Mandawali Fazalpur, East Delhi, Delhi-110092 and Contact number as '7011880844'.

In these circumstances, keeping in view of the averments made in CM APPL. 79643/2025, this Court accepts the unconditional apology tendered by the contemnor.
