The application stands disposed of.

The present petition is filed seeking quashing of FIR No. 886/2020 dated 07.11.2020, registered at Police Station Uttam Nagar, for offences under Sections 323/451/506/34 of the Indian Penal Code, 1860 ('IPC').

Chargesheet has been filed in the present case under Sections 323/451/506 of the IPC.

Respondent No. 2 who used to work at a shop owned by his Uncle, namely, Gopal Garg. It is alleged that on 06.11.2020 at around 07:15 PM, while Respondent No. 2 was sitting at the counter of the said shop, three to four persons (petitioners in the present case) came and after identifying him as the brother of Teena Garg, started beating him with fists and kicks and as a result, Respondent No. 2 sustained injuries. This incident led to registration of the present FIR.

The learned counsel for the petitioners submits that the parties are known to each other.

He submits that the petitioners have tendered their unconditional apology for their behaviour. He further submits that the parties have amicably resolved their disputes and wish to live their lives peacefully in the future.

The petitioners are present in person. They undertake not to indulge in any such activity in future. They state that the parties being neighbours, have decided to bury their disputes and live peacefully in future.

The petitioners further undertake that they will not harass Respondent Nos. 2 to 4 or their family members in any manner whatsoever.

The present petition is filed on the ground that the parties have amicably settled their disputes before Delhi High Court Mediation and Conciliation Centre by way of Settlement Agreement dated 21.11.2024, on their own free will, without any coercion, undue influence, pressure or threat. 11.

The parties are present in person in Court and have been duly identified by the Investigating Officer. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Respondent Nos. 2 to 4, on being asked, state that they are satisfied with the apology tendered by the petitioners. 13.

Respondent No. 2 state that he does not wish to pursue any proceeding arising out of the present FIR and has no objection if the same is quashed.

Offences under Sections 323/451/506 of the IPC are compoundable in nature.

This Court is of the opinion that no useful purpose would be served by relegating the parties to the learned Trial Court for filing an application to compound the offences. 16.

Keeping in view the nature of dispute and that the parties have amicably entered into a settlement, this Court feels that no useful purpose would be served by keeping the dispute alive and continuance of the proceedings would amount to abuse of the process of Court.

However, keeping in mind the fact that the State machinery has been put to motion, ends of justice would be served if the petitioners are put to cost.

In view of the above, FIR No. 886/2020 and all consequential proceedings arising therefrom are quashed, subject to payment of total cost of ₹20,000/- by the petitioners to be deposited with the Delhi Police Welfare Society within a period of eight weeks.

Let the proof of deposit of cost be submitted to the concerned SHO.
