Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'B.N.S.S.') has been filed on behalf of the Petitioner for quashing of FIR bearing no. 0378/2017 dated 04.09.2017 under Sections 354D/506/509 of the Indian Penal Code, 1860 (hereinafter referred to as 'IPC') registered at P.S. Vasant Vihar and all other proceedings emanating therefrom, in terms of the Settlement Deed dated 30.04.2025.

On advance Notice, Mr. Shoaib Haider, learned APP on behalf of the State, has appeared and accepts Notice.

Registrar wherein they have stated that their matter has been settled amicably without any force, fear or coercion. 5.

On query, the Complainant, who appeared through VC has submitted that there was another case under Section 376 IPC registered against one Ravindra, who has opted trial been acquitted. It is further submitted that she had received phone call from a mobile number, which belongs to the Petitioner and under mistaken belief, she had lodged the complaint against him alleging him to be threatening her and sending vulgar and obscene messages. After due investigation, the charge-sheet was filed against the Petitioner in the present matter.

It is now being stated that the Complainant has got married and has a child and is settled in her matrimonial life and thus, has settled the matter. It is also stated by the Complainant that the FIR got registered under some mistake.

Considering the submissions made and that they have voluntarily compromised and specially, in view of the statement of the Complainant that the FIR was registered under some mistaken belief, FIR No. 0378/2017 dated 04.09.2017 under Sections 354D/506/509 of the IPC, registered at P.S. Vasant Vihar and all consequential proceedings emanating therefrom are quashed, subject to payment of cost of Rs.25,000/- by the Complainant in the Advocates Welfare Fund within two weeks.
