% 17.07.2019 The present petition has been filed by the petitioner with the following prayers:
"In the facts and circumstances of the case and in the interest of justice, it is most respectfully prayed that this Hon'ble Court may be graciously be pleased to: a. Allow the present petition while directing respondent for connection / restoration of permanent water, line and connection which has been disconnected at the premises of the petitioner;
b. Pass such other further orders as may be deemed just and proper in the premises of this case."
Mr. Sumeet Pushkarna, learned counsel appearing for the Board states that the prayer as made cannot be granted as there is no water connection in
favour of the petitioner. In the absence of any connection, he cannot seek restoration.
At this stage, learned counsel for the petitioner states that he shall apply for fresh connection which can be considered by the respondent. The learned counsel for the respondent states if an application is made, the same shall be considered in accordance with rule after notifying the owner of the property and appropriate orders shall be passed in accordance with rules. It is ordered accordingly.
Any order(s) to be passed, shall be communicated to the petitioner. The writ petition is disposed of.
