By way of the present petition, the Petitioners seek quashing of FIR No. 12/2023, registered at Police Station Binda Pur, Delhi, for the offences punishable under Sections 498A/34 of the Indian Penal Code, 1860 (hereinafter referred to as the 'IPC') and all consequential proceedings emanating therefrom on the basis of the Settlement Deed dated 23.01.2025 arrived at between the parties.

Issue notice. Learned APP for the State accepts notice on behalf of the State. Learned counsel for Respondent No.2/complainant, who appears on advance notice, also accepts notice.

No.2 is present before this Court. The Petitioners as well as Respondent No.2 have been duly identified by their respective counsel and the Investigating Officer (IO) concerned, Police Station Binda Pur, Delhi. 6.

Brief facts of the case are that matrimonial disputes arose between Petitioner No.1 and Respondent No.2, pursuant to which the present FIR came to be registered against the Petitioners. During the pendency of the proceedings, the parties amicably resolved all their disputes and entered into a Settlement Deed dated 23.01.2025. In terms of the settlement, the parties agreed to dissolve their marriage by mutual consent without any monetary consideration. Thereafter, the marriage between Petitioner No.1 and Respondent No.2 stood dissolved by a decree of divorce by mutual consent dated 28.07.2025 passed by the learned Additional Principal Judge, Family Court, South-West District, Dwarka Courts, Delhi. 7.

On a query made by this Court, Respondent No.2, who has been duly identified by the Investigating Officer, categorically states that she has entered into the settlement out of her own free will and without any force, coercion or undue influence. She further states that the marriage between the parties already stands dissolved by a decree of divorce by mutual consent and that nothing survives between the parties. She has no objection if the present FIR and all consequential proceedings emanating therefrom are quashed. 8.

In view of the above, as the parties have amicably resolved all their disputes, the marriage between them already stands dissolved by a decree of divorce by mutual consent and nothing survives for adjudication between the parties, no useful purpose would be served by continuing the criminal proceedings. Rather, continuation thereof would only result in unnecessary litigation between the parties. Accordingly, FIR No. 012/2023, registered at Police Station Binda Pur, Delhi, under Sections 498A/34 IPC and all consequential proceedings emanating therefrom are hereby quashed.
