The limited prayer in the present petition is to request the learned Trial Court to decide the application filed under Section 431 Cr.P.C. read with Section 421 Cr.P.C. in a time-bound manner.

Mr. Suri, learned counsel for the petitioner/complainant submits that the petitioner had filed a complaint under Section 138 of Negotiable Instruments Act,1881and when the matter was referred to mediation, there was amicable settlement between the parties. Despite such settlement and undertaking given by the respondent/accused, the terms have not been adhered to and the payment, as per the terms of settlement, has not been made. 3.

He submits that, therefore, the applicant herein had to file an application under Section 421 read with Section 431 Cr.P.C. which is yet not decided.

The application, as above, has been moved only in the month of March, 2026 and, therefore, the request made in this regard by Mr. Suri seems to be a little premature and hasty one.

The next date before the learned Trial Court is stated to be 10.08.2026. However, keeping in mind the overall facts, the present petition is disposed of with request to learned Trial court to give requisite priority to the above said application. This is being directed merely to ensure that the rights and interest of the complainant are adequately protected and do not get jeopardised on account of any delay.

A copy of this order be also transmitted to the learned Trial Court for information and due compliance.
