W.P.(C) 901/2017 Petitioner is aggrieved by the inaction on the part of the North DMC/respondent no.1. His submission is that illegal and unauthorized construction is being permitted on the ground floor of property bearing No.F-4/6, Ground Floor, Model Town-II, New Delhi. This is in contravention of the bye-laws of the Corporation. Petitioner is stated to be the owner of the first and the second floor. Submission is that this illegal deviation has affected the status of his property.

On advance notice, learned counsel for respondent has put in appearance. His submission is that the action in accordance with law

has already been taken and a show cause notice has also been issued to the owner/occupier/respondent no.2 on 25.01.2017. His further submission is that after the property has been booked by virtue of the provisions of Sections 343 and 344 of the DMC Act. All other further action in accordance with law shall be completed. Learned counsel appearing for respondent no.1 under instructions from Mr.K.K.Gupta (A.E.) states that a time bond demolition programme has been scheduled and this programme shall be completed within an outer limit of four weeks from today. This statement of the respondent no.1 is taken on record. It is hoped and expected that this commitment shall be honoured in true letter and spirit.

No further orders are called for in this petition. Petition disposed of.
