Petitions under Section 528 of the Bhartiya Nagrik Suraksha Sanhita, 2023 have been preferred on behalf of the Petitioners for quashing of two FIRs, bearing FIR No.0332/2020 under Sections 308/341/506/34 IPC, The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
registered at PS: Madhu Vihar and FIR No.0238/2021 under Sections 376/377/498A/406/506/34/ 328/342/354 IPC read with Section 6 POCSO Act, registered at PS: Bindapur and all consequential proceedings emanating therefrom, in terms of Settlement Agreement dated 21.11.2024. 2.
Learned APP for the State and learned counsel for the Respondents appear on advance Notice.

The dispute in FIR No.0238/2021 arise from matrimonial discord and the allegations therein against the Petitioner are of Section 376 IPC read with Section 6 POCSO. However, the Prosecutrix and the Petitioner Ankit Kumar apparently were in some relationship nearly 10 years ago and they got married on 28.04.2019 according to Hindu rites and ceremonies at Arya Samaj Mandir, Hanuman Road, New Delhi. No child born out of the said wedlock. Thereafter, in regard to incident which happened 10 years ago, FIR got registered.

Essentially, both the FIRs are arising out of the matrimonial disputes and have now been amicably settled between the parties vide Settlement Agreement dated 21.11.2024. Divorce has also been granted to Petitioner No.1 and Respondent No.4 in CRL.M.C. 3131/2025 (who are Petitioner and Respondent No.2 in CRL.M.C. 3130/2025) vide Decree dated 29.11.2024. 5.
The parties are present in the Court and have been identified by the IO. The parties submit that they have arrived at the settlement without any force, coercion and undue influence and pressure and they have signed the Settlement Agreement dated 21.11.2024 with their wish and will. 6.
Learned Counsel for Petitioners submits that the parties have no grievance against each other. Since Respondents have already made a statement before the Court that she does not want to pursue the proceedings The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
in FIR, the present Petition be allowed and FIR Nos.332/2020 & 238/2021 be quashed.

In view of Settlement Agreement dated 21.11.2024, present Petitions have been filed.

Respondents are present and submit that they have no grievance against the Petitioners and also no objection to the quashing of FIR. 9.
In view of the fact that the FIRs in question were premised upon a matrimonial dispute between the Petitioners and the Respondents, which has been amicably resolved in terms of Settlement Agreement dated 21.11.2024. Considering the fact that parties have resolve the dispute amicably and have also given no objection to the quashing of FIR, no fruitful purpose would be served in continuing with the proceedings arising out of the FIR. 10.
Consequently, FIR No.0332/2020 under Sections 308/341/506/34 IPC, registered at PS: Madhu Vihar and FIR No.0238/2021 under Sections 376/377/498A/406/506/34/ 328/342/354 IPC read with Section 6 POCSO Act, registered at PS: Bindapur and all consequential proceedings emanating therefrom are quashed.
