The present Petition has been filed seeking quashing of the Complaint Case bearing No. 50146/2016 registered under Section 138 of the NI Act, 1881 whereby the petitioner had been summoned. 2.
It is submitted that the Learned MM vide order dated 02.09.2020 dismissed the Application of the Petitioner seeking discharge by observing that there was no jurisdiction with him to discharge the accused. 3.
It is evident from the record that essentially the Petitioner had challenged the Summoning Order dated 25.11.2016 by seeking discharge which was dismissed by learned M.M vide the impugned order but the petitioner has been following this Petition erroneously. In any case, it is the Order of the learned MM against which the alternate efficacious remedy of challenging it before the learned ASJ.

under challenge and the present Petition is not maintainable on the ground of delay and laches.
