% 10.06.2019 Present petition has been filed seeking simultaneous release of the petitioner on parole with other convict.
There is no representation on behalf of the petitioner. Learned ASC for the State states that vide order dated 03.06.2019, furlough of three weeks has already been granted to the petitioner on certain conditions. The petitioner had filed the parole petition on medical ground. The only hesitation of Jail Authorities in releasing the petitioner is that another co-convict is already on fourlough.
Rule 1224 of Delhi Prison Rules provides for simultaneous furlough where they are family members or there are exceptional circumstances.
In view of medical grounds mentioned in the petition, the
petition for simultaneous release of the petitioner for a period of 3 weeks is allowed subject to conditions as imposed in order dated 03.06.2019. Petition is accordingly disposed of. Copy be sent to Jail Superintendent for intimating the petitioner and for necessary action.
