Learned counsel for the respondent submits that the present appeal is directed against the order dated 17.02.2025, whereby the Trial Court allowed the review petition and set aside its earlier order dated 02.09.2022, by which the application under Order XII Rule 6 CPC had been allowed and the suit decreed. He further submits that, upon a prayer made by the plaintiff, the underlying suit was permitted to be withdrawn with liberty to file the same before the Court having appropriate jurisdiction. The said order was passed on 07.07.2025 in CS DJ 408/2022. He thus submits that the present appeal has become infructuous in light of the aforesaid development. 3.

In view of the non-appearance on behalf of the appellant and the aforesaid submission made on behalf of the respondent, the present appeal, along with the pending application, is disposed of as infructuous.
